I have the same frustration ... rules that are so vague and that USCIS doesn't even follow ... and I got all worked up about it when the predictions for the October bulletin came.
But then I told myself I have no control over this and the only thing it does it's ruining my days which makes it a lose - lose situation for me.
And before someone tells me that I have the power to change things by joining IV efforts, I'll tell you that I already did that.

In order to use left-over visa numbers from EB1 and EB2-ROW, the PD cut-off for China and India must be locked. That's one of the reason why India's cut-off date has also moved.

I agree 100%. They also issued green cards to ppl whose PD was not current in June. Even that is a violation of law.

Now I clearly understand even though it is not good news :( since people from the backlogs centers are getting their LC approved with a PD prior than mine !!!
Anyways I can't complain right? i still can renew my EAD and travel documents so I guess my turn will come soon...hopefully!! :D

I completely agree with you . For five years EB3 is stuck in 2001 that means people who came here 10 years back are still waiting. Something needs to be done by someone somewhere but I guess no one has any idea who can ( except the congress ) .
All of my friends about 10-15 of them who came with me in 2000-2001 timeframe got their GC's and their citizenships in EB3 ( none in EB2 ) and I am still hanging .
I wonder what was that which made their application go by light speed and my application go into a blackhole :)
Probably, their labor got approved before the FY2006 when the retrogression started. All the categories were current until then due to the recapture done by AC21. I am stuck in this mess because my labor took 5 years to get approved.

count me in.... but we should also include not just this but also Flexibility of all and any one who is on H1 and H4. immeterial of they in EB2 or EB3. All one is required is Flexibility ...
Flexibility to leave the current job and go join a college without worrying about status
Flexibility to take a vacation for a month to visit places and friends without worrying about nex project
Flexibility to change employers and get a better position and offer
Flexibility to work in position you deserve..rather than rot in the same job profile b'cos your GC process is pending
Flexibility to invent and develop ideas and work on itself rathar than work for some company which undermines, underpays those ideas and inventions

There are many ethnic TV channels in the USA. For instance Asianet is Kerala Channel. Sun TV is Tamil I guess. Can we think of doing advertisement on some of these channels? It could be expensive, but I think it would be worth trying....

right..ok..today at work I heard from my colleague that his friend was sent back from airport
My colleague's friend's story.
Went to india for 3 weeks vacation..at POE, officer called his employer and asked "do you need him(a H1B) to work for this position? Cant you find any US Citizen?".
Apparently, the response from employer ( I think Desi consulting)is, "Yes..we dont need him..can find a USC"..
The poor guy is sent back.
Now, I asked my friend to inform his colleague to come forward and post his story at IV..but I doubt if he cares Rat's as** now that he is kicked out.
hmmm...I have a travel coming up in Nov/Dec...with all adventurous luck going on with me, I have other plans now :confused::confused:

I'm killing my own joy here...... the Aug Bulletin says
"Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; the Bureau of Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status."
Documentarily Qualified (DQ'd)
USCIS and Consulates submitted a list of Documentarily Qualified applicants to DOS on July 8th. The latest PD of the applicants on that list was before 01-June therefore they have set the PD at 01-June-2006.
What is documentarily qualified?

Even though IV has 25000 "registered" members. There are only 400-500 visitors. The same people visit the site often. The number of visitors dramatically increase, if there are newsworthy events that affects most of the people.
So the sample size is NOT 25K but around 500, based on the daily visits.
This of course is not a whole lot but Idea is not to be statistically correct but to feed newsworthy information to the Media, and here are the facts.
a) 1 MM people in the line for EB green card
b) All of them highly skilled with at least bachelors
c) Average income 75K +
d) Average family size: Slightly more than 2 .
e) Life Dream : The American Dream
f) Bottleneck to the life dream : The long ,excruciating backlogs.

My dear friends USCIS was like that only since ages and because of it Labour Backlogs were created
To resolve these issues they started BP Centers
Then again came New labour system-- but still old habits die hard and see what happened to the new labour system
now DOL is playing with us with their new cutoff dates.
So Please forget about EB2 and EB3 lets all unite and fight for final push for EB reforms to get GC.

I talked to my Professor where I did my masters and he agreed to sign the online petition. He is one of top researchers in his field. Imagine if we can get signatures from such great . Professors, outstanding Scientists, CEO's and Directors of big companies, Journalists (like the one who wrote nice article in Washington post about legal immigration) and probably Bill Gates. This would create great attention for our cause. They are lots of people out there who support legal immigration and its time to bring them together and show it to the world in a petition.
If anyone thinks this is a good idea, can you just leave a message saying that you support it. At least we know how many people are interested in this forum.
I will gladly sign this petition as well.
Can you please ask your professor to call Rep.Lamar Smith to voice his support for the Lofgren bills? That would be greatly appreciated.

Please correct your spelling of Murthy. I thought some senator or Congressman Murphy wrote to DOS. If it was murthy I wouldn't have bothered to come on this thread. She is a big time crook. Shamelessly she's trying to take credit of everything that we are doing here under 1 banner called immigrationvoice she will take credit of Zoe Lofgren and everybody else. She has never ever mentioned immigrationvoice for anything in her so called updates.
