I am bumping up this discussion.
1. After quick scan of PMBOK3, I am unable to find "software project" specific management processes in PMBOK. (except few words here and there).
2. Few months back, I talk to an Architect who has run through PMBOK. He rates it is closer to junk.
3. Today, I talked to non PMP "software project" manager. he says PMP is off in most of the areas in SP and not needed.
Or am I missing some thing?
Please note: I am not looking for generic management here( I am a MBA thank you ). I am not against reading PMBOK. All I want to know is the relationship between “software project” and PMP and the practical advantage of PMP certificaiton in day2day work.

I do have copy of labor approval but I donot have copy of job description that they filed for labor. I also have copy of 140 approval.
I don't think I can get letters from HR (there are couple of people who handles everything from getting timesheets to posting payslips) as they very loyal to my employer.
Then I guess my only options are
- give it a try to file through another attorney with paystubs and without employer letter.
- forget about $5000 and proceed.

Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.
Totally agree! But I an fed up of everyone showing up and asking all the time "What about Quarterly Spillover?" all the time. It will make a difference of 6-7 months and its a real big deal to keep coming back and asking "Pappu did you ask about Quarterly Spillover? " on each bloody occasion. Let me tell you what most EB3 India think. You can spillover horizontally or vertically I get it the same time. So why should I care about this spillover BS. Just coz we were born in the same country! Anyways good luck to EB2 India applicants. Hope you get your GC's soon

Hello Friends,
As you might have guessed, I am on the EB3 bandwagon because of circumstances that were beyond my control [The filing attorney screwed up :( ]
At the time of my EB3 filing (Feb. 2004) I did possess a Masters degree and more than 5 years of Work Experience and the job responsibility that my petition was filed for, did require a Senior worker with Masters experience. Unfortunately, things didn't go that way and here I am.
I keep reading about some lucky souls [god bless their souls :) ] who have managed to retain their priority dates and converted to EB2.
I really want to do that. I am not sure where to start.
1. I used AC21 and took up a new job recently. Do I approach my new employer and talk to them to see whether they would be able to file my petition in EB2 category? The bad thing is, when I joined them, I told them I don't need any sponsorship or assistance from them. It would be a volte face to go back to them and request them to do something. And the best part is, there is no guarantee that my company would file my petition.
2. Do I look for a new employment and if and when I clear the selection process, do I tell them that the only way I could join them is if they could file my EB2 petition? If they think that my services is a necessity, they might do it else they might look for other candidates. It s like throwing a dice.
3. Do I look around for desi consulting companies that would file my EB2 and in return I work for them (using my EAD) through the EB2 petition/adjudication process. With this approach, the desi companies might do it, but like other people, I also think the reputation of these desi consulting companies is severely dented and there is all the more chance that the EB2 petition might get denied.
Gurus...any help or advise or information is really appreciated.

I would say all three options you listed in your post are good and worth pursuing in the order they are listed...i.e., talk to you current employer about EB2 and if they are not willing, look for a new employer who is willing to do EB2. I am not a big fan of option #3 as I have had bad experiences with my very first desi employer in US, but there may be good ones out there.

Canada has the stupidest immigration policy from the standpoint of policy maker if you ask me.
Dont get me wrong. It works great for us. For the immigrant. You get greencard on an independent petition(self-petition) and adjudicated based on points. And there is no numerical cap.
Guess what? It works great for everyone in the world, everyone has flocked there and caused and over supply of labor and 9% or higher unemployment. The way they count unemployment is also very Enron-like. They dont count people receiving unemployment benefits as unemployed. And then Jim Volpe will post on website "Canada has unemployment rate of 5-6%".
Anyways, if you want to immigrate to a country, you want to go where there is low unemployment. That is the biggest criteria for choice. USA's system HAS HUGE FLAWS. The employer petition-system creates a breeding ground for exploitation and the numerical cap is too low that results in delays that are unbearable. And yes, the DOL has come really close to making people commit suicide because of labor backlogs. But then, only the employer petition system can actually give greencards to THOSE WHO CAN SURVIVE and get jobs in the economy and not give greencards just because they scored points.
I know I will receive a lot of flak as I have before, and I wish there was points based system here in USA too with self-petition option like Canada, but trust me, if that happens, then this country will be full of people with greatest points,(obtained thru fake degrees and Ph.Ds from the whole world) and really really make the nightmares of NumbersUSA and FAIR become true, and it wont be worth living.
US systems needs major rework and increase in quota and increase in efficiency at USCIS and DOL. But getting rid of employer petition is going to make USA like Canada where Ph.Ds and doctors drive cabs and work in restaurants, but every one of those doctors and engineers would have greencard in 1 year.

Sorry to hear about your case.
From what I have heard, you can apply for I485 till your case gets adjudicated. Your PD is Dec 2003. It will easily take 2 to 3 years to get approval. In that time, get your divorce papers, get married, bring your new wife in H4 and apply for her 485. I think you'll be good.
I am not sure what will happen to your ex. You may need to revoke her 485 application. not sure if you can just revoke hers or you need her to sign some application (which she may not be willing to).
Check with an attorney. They should be able give you the best advice.

I think it is nice that you are trying to see the thing from a positive side, but the reality is that for most of professionals lack of GC does make a big difference. As far as I people who wanted GC and once get it remain with same employer, I think that is a matter of personal preference. I can tell you that once I got the EAD - not even the greencard - that made an important difference in my life. Immediately I applied and got a temp/part-time opportunity, which provided me with additional source of income and job satisfication. My wife started working. I became eligible for Federal Financial Aid to sponsor my masters program. You can see how living in a limbo sucks.
Moreover, even if it turns out one chooses to stick with same employer after getting the GC, at minimum one can be eligible for unemployment insurance, get any job, etc.
I have several friends who were waiting for GC desparately and they thought it was the final destination. They had many reasons why to get GC and once they get, they will be free and can do / will do everything possible. But, once they got it, they settled in a permanent job. Without GC, they were working for the same client with even more pay and life was good if not better.
I was thinking the same way; because I am no different.
Oflate, I realised, I am un-necessarily worried about something which is not in my control. I realised that I am well paid, with this pay even the benefits I am not getting are compensated. Why am I worried? Should I be after GC in order to get peace of mind? I started looking it little differently. I am in this country to earn more money and live comfortably. I am already enjoying what I wanted. Then, why am I worried still? May be it is in human nature to always look for something which is not in the hands.
I still need GC for other things like Children education and get some other benefits (our education / starting business etc). I agree, but there is lot of time for that in my case. There are several people who are in the same state as me if not all. Everyone's needs are different.
I thought I will just share my ideas so that atleast some of the people will be happier.

Your most compelling argument of preponing your visa interview is that they have opened slots which were not earlier available and you would like to finish this process and keep some time incase some additional documentation was required, you would have the time to get it. Also, there is NO RULE that says you cannot prepone appointment.
Also, I suggested you get a fresh appointment at Mumbai (your original appointment was in Chennai - correct?)

My lawyer has specifically recommended against re-filing. He said exact duplicate applications in the system is a really bad idea and could get to both being rejected. This is different from the case that if one has missed something in the first one, he can re-file.
No where in the I-485 standard operating procedure do they mention that second filing will be rejected. This is what they say:
"Second filings refer to I-485 applications submitted to a service center with
a new filing fee even though one may be pending at another INS office.
Second filings will be handled under the normal process."
Just mention in the cover letter that you are mailing again because you didn't get a receipt notice even after 60 days and that USCIS has issued an update that they have processed all application past your mailing date.
No where in the I-485 standard operating procedure do they mention that second filing will be rejected. This is what they say:

It seems people who revoked AC21 during pre-GC stage, can continue to change employers in the post-GC phase. The confusion is for the people who stayed with their employers throughout the GC process. Please correct me if I am wrong.
